1. Agreement to Terms
By accessing or using WageDamages.net ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.
2. Description of Service
WageDamages.net provides preliminary wage and hour damages estimates for California employment law cases. This Service is a calculation tool and does NOT constitute:
- Expert testimony or opinion
- Legal advice
- Professional consulting services
- Certified financial analysis
All outputs are watermarked "Preliminary Estimate — Not a Professional Opinion."
3. User Accounts
When you create an account with us, you must provide accurate, complete, and current information. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account.
You are responsible for safeguarding your password and for all activities under your account.
4. Subscription Plans and Billing
4.1 Free Tier
- 3 case evaluations per month
- California overtime violations only
- No exports or saved cases
4.2 Solo Tier ($79/month)
- Unlimited case evaluations
- All California violation types including PAGA
- PDF and Excel exports
- Unlimited saved cases
4.3 Firm Tier ($199/month)
- Everything in Solo Tier
- Up to 5 users
- Firm branding on reports
- API access
- Priority support
4.4 Billing Terms
Subscriptions are billed monthly in advance via Paddle. You may cancel at any time, and cancellation will take effect at the end of the current billing period. No refunds are provided for partial months.
5. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any laws
- Attempt to reverse engineer, decompile, or extract source code from the Service
- Use automated tools to access or scrape the Service without permission
- Share account credentials across multiple users (unless using Firm Tier multi-user access)
- Represent outputs as expert testimony or certified opinions
6. Accuracy and Limitations
While we strive for accuracy, WageDamages.net:
- Does NOT guarantee calculation accuracy for all scenarios
- May contain outdated statutory rates if not regularly updated
- Cannot account for case-specific factual nuances
- Should be verified by qualified experts before use in litigation
Users should verify minimum wage rates, penalty amounts, and legal interpretations independently.
7. Limitation of Liability
To the maximum extent permitted by law, WageDamages.net and its operators shall not be liable for:
- Any damages arising from use or inability to use the Service
- Errors or omissions in calculations
- Decisions made based on Service outputs
- Loss of data or case information
8. Intellectual Property
The Service and its original content, features, and functionality are owned by WageDamages.net and are protected by copyright, trademark, and other intellectual property laws.
9. Data Retention and Deletion
We retain user data as long as accounts are active. Upon account deletion, all case data is permanently removed within 30 days.
10. Modifications to Terms
We reserve the right to modify these Terms at any time. We will notify users of material changes via email. Continued use of the Service after changes constitutes acceptance of the new Terms.
11. Termination
We may terminate or suspend your account immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.
12. Governing Law
These Terms shall be governed by the laws of the State of California, without regard to its conflict of law provisions.
